Terms and Conditions of Freestanding Pole Dance Podium Hire

General

The terms and conditions set out below shall be the basis of all Contracts of Hire with Twisted Hen & Stag Parties which shall be concluded by any person, persons or body corporate and the handing over of goods by Twisted Hen & Stag Parties. Any offer of equipment is subject to equipment being available on receipt of an order. The hirer is responsible for making the venue aware of delivery and collection times.

Definition

In these terms and conditions Twisted Hen & Stag Parties trades under Pole Twisters Ltd whose principal place of business is Unit 4 Templar Parc, East Moors Road, Splott, Cardiff, CF24 5EW. The hirer shall mean any person, persons or body corporate entering into a rental agreement with Pole Twisters Ltd for the hire of goods and equipment. “Goods and equipment” referred to in “The terms and conditions” refer to those set out below and shall be the sole conditions of any contract with Pole Twisters subject to any addition or amendment which shall be in writing and ratified by a Director of Pole Twisters.

The Period of Hire

1. The period of hire shall commence with the hirer taking possession of the equipment (whether or not such receipt shall have been from Twisted Hen & Stag Parties) and shall terminate when equipment is collected by Twisted Hen & Stag Parties.

2. Where equipment is delivered, such delivery is at the hirer’s risk and expense and the hirer shall be liable for physical loss and damage and delay to the equipment from the time the equipment arrives at the venue premises and until it is collected by Twisted Hen & Stag Parties

Equipment

1. The hirer will satisfy himself on taking possession of all equipment that it is in good working order and in undamaged condition. Any matters relating to the substandard condition or working of the equipment must be referred to Twisted Hen & Stag Parties

2. All equipment on hire remains the absolute property of Pole Twisters.

3. The hirer shall have no authority to transfer or otherwise part with possession of the equipment during the period of hire unless the express written consent of Twisted Hen & Stag Parties is first obtained.

Damage or Loss to Equipment Hired

1. It shall be the absolute responsibility of the hirer to ensure the safe keeping of equipment and the hirer will indemnify Twisted Hen & Stag Parties in respect of any loss or damage howsoever caused whilst in the hirer’s possession.

2. All damage or loss will be notified to Twisted Hen & Stag Parties immediately (or as soon as practicable) following which the goods must be returned to Twisted Hen & Stag Parties for repair or replacement should repair be uneconomic. The hirer shall make no attempt to examine, diagnose, repair or remove the outer casing of the equipment hired.

3. The hirer shall be liable to pay the full cost of repair and / or replacement of any equipment lost or damaged beyond repair with reference to new equipment of the same or nearest available specification.

4. The hirer shall ensure that equipment is used only in accordance with the directions of Twisted Hen & Stag Parties

Liability

1. Twisted Hen & Stag Parties shall not be liable under any circumstances whatsoever for losses incurred by the hirer due to faulty or non-functioning equipment during the period of hire. Twisted Hen & Stag Parties will however take all steps to ensure that faulty equipment is replaced as soon as possible with either the same or similar equipment.

2. The hirer will indemnify Twisted Hen & Stag Parties at all times fully against any liabilities, demands, actions, claims or proceedings arising from or in connection with the equipment hired.

3. In the event that the hirer shall create, use with or in conjunction to any equipment hired any unique or original material or matter Twisted Hen & Stag Parties shall have no liability whatsoever in respect of the loss, damage or imperfection of any such material and the hirer will fully indemnify Twisted Hen & Stag Parties in respect of any such claims by a third party.

4. Pole Twisters Ltd have 1 million public liability insurance and 10 million employers liability insurance, copy of certificates available upon request

Rental Fees

1. The hirer will pay a non-refundable deposit of £150 online to confirm the order. Deposits are non-refundable because of the organisation of overnight accommodation, plus admin, travel, parking and any other required fees for the booking. However if changes to accommodation or travel can be achieved, Twisted Hen & Stag Parties may be able to change the booking date or offer credit on your account

2. The final balance will be paid in cash on arrival subject to the amount listed on Twisted Hen & Stag Parties website or otherwise agreed by email. Should full settlement not be made by the day of hire to the delivery driver, then Twisted Hen & Stag Parties reserves the right to forfeit the contract and retain the non-returnable deposit plus automatically charge the Hirers credit or debit card, or take further steps or court proceedings to obtain the final balance

3. Twisted Hen & Stag Parties reserve the right to determine the contract and recover any equipment hired in the event of bankruptcy, insolvency or liquidation of the hirer.

4. Where the hirer is a body of corporate registered in the United Kingdom, Twisted Hen & Stag Parties may in their sole discretion require a surety to the equipment hire. The surety hereby agrees to indemnify Twisted Hen & Stag Parties in respect of all sums due under the Contract of Hire in the event of partial or total default by the Hirer Company.

Force Majeure

Whilst every effort will be made by the Company to complete any orders, the Company cannot be held liable for variation or non-completion of orders due to Act of God, Fire, Flood, Storm, Gale, Tempest, War, Pandemic, Terrorism, Strikes, Riots, Lockouts or any other civil disturbances.
